Image rights terms and conditions

When accepting rights requests you are allowing Age UK (charity number: 1128267) and its group of subsidiary companies and charities (the Age UK Group) to use your personal social media content (“Content”) in its marketing campaigns and activities.

The Age UK Group will request rights to use your Content by commenting on your Instagram post or via Twitter or howsoever may be applicable to the social media on which you have posted your Content. We will request a response from you authorising us to use of your Content. To agree to us using your Content simply reply using the hashtag #YesAgeUK.

By responding #YesAgeUK you acknowledge and agree to the following:

1. You grant the Age UK Group a royalty free, perpetual, transferable licence to use and authorise the use of the Content in any media and for any commercial and/or non- commercial purposes throughout the world, which may include, but is not limited to use on the Age UK website, any of Age UK's social media platforms, publications, advertising, fundraising, campaigns or other marketing materials;
2. We may alter and/or edit the Content in any manner, or combine the Content with other materials, without seeking further permission from you;
3. That (i) you own the copyright and waive any moral rights in the Content, or that you have obtained all necessary rights, consents and/or waivers from the owner to upload the Content to grant the rights set out in these Terms and Conditions; (ii) you are the person featured in the Content and/or you have permission from any person(s) appearing in the Content (and, if they are under 16, their parent or legal guardian as well) to grant the rights set out in these Terms and Conditions; (iii) you are 18 years or older; and (iv) our use of the Content in accordance with these Terms and Conditions will not violate any other rights of any third party or any law; and
4. That you do not object to the Age UK Group storing copies of the Content in any form for the purposes set out above, transferring the Content outside of the European Economic Area (“EEA”) or storing the Content at a destination outside the EEA for the purposes set out above. You acknowledge that the Age UK Group does not need to provide prior notification of any distribution and representation of the Content, is not obliged to use the Content and has the discretion to use or remove the Content, in whole or in part, from any communication or media without prior notice to you.

This agreement shall be governed by and construed in accordance with the laws of England and Wales and the parties hereby submit to the exclusive jurisdiction of the English courts.
